We are expert prenuptial agreement solicitors

A prenuptial agreement can give both parties greater certainty about how finances and other assets would be handled if their marriage were to come to an end. It can also help couples discuss their financial expectations openly before getting married or entering a civil partnership.

Our family law solicitors provide tailored advice on preparing, reviewing and negotiating prenuptial agreements. We can help you consider:

  • Property owned before the marriage.
  • Savings, investments and pensions.
  • Business ownership and professional interests.
  • Inherited assets and expected inheritances.
  • Trusts and family wealth.
  • Existing financial commitments.
  • Financial provision for children.
  • Future income and changes in circumstances.
  • Protection from the other party’s debts.
  • International assets and overseas connections.

We take time to understand what matters to you before creating an agreement that is clear, balanced and appropriate for your relationship and the life you will lead together.

Drafting a bespoke prenuptial agreement

Every couple has different financial circumstances, so a prenuptial agreement should never be treated as a standard document. Our solicitors will take time to understand your assets, income, responsibilities and plans for the future before drafting an agreement that suits your needs. Your agreement can address property, savings, investments, business interests, pensions, inheritances and financial support. It may also clarify how assets acquired during the marriage should be treated if you later separate.

We will explain the legal position in straightforward language and help ensure the agreement is entered into voluntarily, following appropriate financial disclosure and independent legal advice. Although prenuptial agreements are not automatically legally binding in England and Wales, a carefully prepared agreement can carry significant weight in court if it is fair and meets both parties’ needs.

Reviewing and negotiating a proposed agreement

If your partner or their solicitor has presented you with a prenuptial agreement, it is important to gain independent legal advice before signing it. Our family law solicitors can review the proposed terms, explain how they may affect you and identify anything that needs further discussion or changes. We will consider whether the agreement provides a fair reflection of your financial circumstances and whether sufficient disclosure has been provided. We can also help negotiate changes relating to property, income, pensions, business assets, inheritance or future financial support.

Our approach is constructive and focused on helping both parties reach an agreement without overcomplicating the situation or creating unnecessary conflict. We will make sure you understand the document and its potential consequences so that you can make an informed decision without feeling rushed or pressured.

Postnuptial agreements and agreement reviews

Financial circumstances can change considerably during a marriage. You may start a business, receive an inheritance, purchase property, have children or experience a significant change in income. A postnuptial agreement can record how you and your spouse would like finances to be handled if you separate in the future. Our solicitors can also prepare a postnuptial agreement for couples who are already married or review an existing prenuptial agreement to determine whether it remains appropriate to current circumstances. Regular reviews may be particularly important following major life events such as business success, or substantial changes in wealth.

We will help you update the terms fairly and ensure both parties understand the revised agreement. This provides an opportunity to maintain clarity, address new circumstances and reduce the potential for financial uncertainty if the relationship later breaks down.

Prenuptial agreement FAQs

What is a prenuptial agreement?

A prenuptial agreement, often called a prenup, is a document entered into by a couple before marriage. It records how they intend to manage their finances and divide assets if they later separate or divorce. The agreement can cover property, savings, investments, pensions, business interests, inheritances and debts. It can also set out whether either person would receive financial support. Each agreement should be tailored to the couple’s circumstances and prepared with independent legal advice.

Prenuptial agreements are not automatically legally binding in England and Wales. Yet courts can give significant weight to an agreement when deciding a financial settlement if it was entered into freely, both parties understood its implications and its terms are fair. The agreement should also meet the reasonable needs of both parties and any children. HM3 Legal can help ensure the correct steps are followed, improving the likelihood that a court would take your agreement into account.

You should begin the process as early as possible, ideally several months before your wedding. This allows enough time for financial disclosure, independent legal advice, negotiations and any necessary amendments. As a general guideline, the agreement should be completed at least 28 days before the wedding. Leaving it until shortly before the ceremony could create concerns about pressure to sign the agreement, or insufficient time for proper consideration. This may reduce the weight given to the agreement by a court.

A prenuptial agreement can address many different types of assets, including property owned before the marriage, savings, investments, pensions, business interests and assets, and valuable personal possessions. It can also cover inherited wealth, trust interests, future inheritances and assets held overseas. The agreement may distinguish between assets that should remain separate and those that will be shared. Our solicitors will examine your complete financial circumstances and help create terms that reflect your priorities while remaining fair to both partners.

A prenuptial agreement can set out how a business or professional interest should be treated if your marriage ends. It may identify the business as separate property, address any increase in its value and specify whether your spouse should receive compensation from other assets. While the court retains discretion during divorce proceedings, a properly prepared agreement can provide valuable evidence of your shared intentions. Specialist advice is particularly important where businesses, shareholders, employees or family members could be affected.
